FOPM HRiX Terms of Use and Privacy Policy

Welcome! FOPM Human Resources Integrated Experience (“FOPM-HRIX”) is a Mobile Application and Web Application developed by iFAE Online Solutions, Inc. (“iFAE”) for First Oceanic Property Management, Inc. (“FOPM”) and Georgia Technosystems, Inc. (“GTI”). By downloading, installing, using, registering, or accessing any content, data, or features provided through FOPM-HRIX, the user agrees to be legally bound by the following terms and conditions (“Terms”).

These Terms govern access to and use of HRIX, whether via mobile, web, or any other supported platform, and constitute a binding agreement between the user and FOPM and/or GTI. Continued use of HRIX signifies ongoing acceptance of any updates, revisions, or modifications to these Terms.

Users are advised to read these Terms carefully prior to using the application. Those who do not agree are enjoined from accessing, downloading, installing, or using FOPM-HRIX and must cease access immediately.

Definition of Terms
  • HRIS: Refers to the Human Resources Information System (HRIX), managed and maintained by FOPM and GTI, and powered by iFAE.
  • User: Any individual granted access to FOPM-HRIX, including employees, HR staff, authorized officers, and administrators.
  • FOPM: First Oceanic Property Management, Inc.
  • iFAE: iFAE Online Solutions, Inc.
  • GTI: Georgia Technosystems, Inc.
  • Personal and Sensitive Personal Data: Information that can identify an individual as defined under the Data Privacy Act of 2012.
  • System: The technical infrastructure and software components comprising FOPM-HRIX.
  • Third-Party Providers: External vendors providing integrated services to FOPM and GTI through HRIX.
1. General Provisions

HRIX is a proprietary platform for HR processes governed by Philippine law and internal company policies. Unauthorized use may result in disciplinary or legal action.

1.2 Authority

Only authorized employees and representatives may access HRIX. Sharing credentials is strictly prohibited.

1.3 Data Accuracy

Users must keep their information true and updated. False data may result in penalties or liability.

1.4 Prohibited Activities
  • Sharing login credentials
  • Unauthorized data access or disclosure
  • Uploading malicious software
  • Disrupting system operations
  • Using HRIX for unlawful or personal gain
1.5 Copyright and Images

Uploaded media remains user-owned but grants FOPM and iFAE a license for legitimate business purposes.

1.6 Copyright Notice

All HRIX content is intellectual property of FOPM and iFAE. Unauthorized duplication is prohibited.

1.7 Third-Party Links

External services linked within HRIX are not controlled by FOPM. Users assume responsibility when interacting with them.

1.8 Restrictions on Sale or Distribution

Users may not sell or exploit HRIX content without written consent.

1.9 Hyperlinking Restrictions

No third party may embed HRIX without prior written approval.

1.10 Compliance with Local Laws

Use must comply with Philippine labor and data privacy laws.

1.11 Software Usage

Reverse-engineering or decompiling HRIX is prohibited.

1.12 Changes to HRIX

FOPM and iFAE may modify or suspend system features at any time without notice.

1.14 Effectivity

These Terms take effect upon download and remain valid until updated.

2. General Use of Services / Access
2.3 Prohibited Users

Suspended users cannot regain access without formal approval.

2.4 User Profile & Announcements

Users must maintain accurate profiles and treat system memos as official communication.

2.6 Availability

HRIX may be unavailable during maintenance. Users should save data regularly.

3. User Accounts
3.1 Username / Password

Credentials and biometric authentication must remain confidential. Sharing is a violation.

3.2 Purported Use

Users are responsible for all actions under their account.

8. Suspension / Termination

FOPM may suspend or terminate access at any time.

11. Account Registration

Accounts must be issued by HR. Unauthorized registration is prohibited.

13. Disclaimer

HRIX is provided “as is” and “as available.” Use at your own risk.

14. Consent to Disclosure

By using HRIX, users consent to lawful data processing and sharing for HR purposes.

15. Indemnity

Users hold FOPM and iFAE harmless from liabilities due to misuse or malicious activity.

16. Data Privacy & Security

All personal data is encrypted and handled in accordance with the Data Privacy Act of 2012.

16.2 Data Retention

Data may be retained as required by law and for audit or compliance purposes.

20. Miscellaneous Provisions
  • 20.1 Cumulative Rights: All rights are cumulative.
  • 20.2 No Waiver: Failure to enforce a term is not a waiver.
  • 20.3 Severability: Invalid provisions do not affect others.
  • 20.4 Third-Party Rights: None unless explicitly stated.
  • 20.5 Governing Law: Philippine law applies; venue in Taguig City.
  • 20.9 System Records: Electronic records are valid evidence.
  • 20.10 Delegation: FOPM may assign HRIX functions to qualified vendors.
  • 20.11 Assignment: Users cannot assign rights without consent.
  • 20.13 Account Responsibility: Users must secure credentials and update passwords.
  • 20.14 Consent: Continued use signifies full agreement to these Terms.

Privacy Notice

FOPM, GTI, and iFAE are committed to protecting the personal data of their employees, which includes personal and sensitive personal information as defined under the Data Privacy Act of 2012 (RA 10173). This Privacy Policy outlines how such information is collected, processed, and protected in accordance with the Data Privacy Act of 2012 and its Implementing Rules and Regulations (IRR).

1. Personal and Sensitive Personal Information Collected

The FOPM-HRiX system collects the following types of data:

  • a. Basic Identification Data
    • Full name, gender, date of birth, address
    • Employee number, contact number, email address
    • Profile photo and mobile app self-portrait (for attendance verification)
  • b. Employment Data
    • Department, position, status, salary, tax classification
    • Leave credits and usage, attendance records
    • Loans, deductions, government-mandated contributions
  • c. Government and Banking Information
    • SSS, PhilHealth, PAG-IBIG, and TIN numbers
    • Bank account information for payroll disbursement
  • d. System-Generated Data
    • Time in/out logs with geolocation
    • Application usage logs and access timestamps
    • Device and browser metadata (for technical support and audit trails)
2. Purpose of Data Processing

FOPM processes your data for the following lawful and legitimate purposes:

  • HR Administration – profiling, onboarding, employment tracking
  • Payroll and benefits – salary processing, loan management, deductions
  • Attendance and timekeeping – biometric/self-portrait verification, geolocation tracking
  • Compliance – government reporting to SSS, PhilHealth, PAG-IBIG, and BIR
  • Internal analysis – manpower reports, HR analytics
  • Security and fraud prevention – misuse detection, system monitoring

Use of your data is lawful, necessary, and proportional to the fulfillment of employer obligations and system functions.

3. Data Disclosure and Sharing

FOPM may disclose your personal and sensitive personal data to the following, for legitimate business and legal purposes:

  • Authorized internal departments – HR, Finance, Admin, IT
  • Government agencies – SSS, PhilHealth, BIR, PAG-IBIG, DOLE
  • Banks and financial institutions – for payroll disbursement
  • Regulatory or legal authorities – upon lawful orders or subpoenas

All third-party disclosures follow strict confidentiality protocols and are bound by Data Sharing Agreements and applicable privacy safeguards.

4. Your Rights Under the Data Privacy Act

As a data subject, you have the right to:

  • Be informed of how your data is collected and used
  • Access your personal and sensitive personal data
  • Rectify inaccurate or outdated data
  • Object to processing under legitimate grounds
  • Withdraw consent at any time (where applicable)
  • Lodge a complaint with the National Privacy Commission (NPC)

Requests may be submitted via formal letter or email to FOPM’s Data Protection Officer (DPO).

5. Data Storage, Retention, and Disposal

All personal data stored within the HRIS shall be classified based on sensitivity and purpose of processing (e.g., payroll data, employee records, medical records, biometric data) to determine access levels, storage security, and disposal schedules.

Upon separation from FOPM, HRIS user access shall be automatically revoked within thirty (30) calendar days from the employee’s official separation date. Role-based access reviews shall also be conducted periodically to remove or revise access of users who have changed roles, been reassigned, or transferred departments.

Archived records beyond active HR processing periods shall be moved to encrypted, access-restricted long-term storage and accessed only for legal, regulatory, or audit purposes by authorized personnel.

Retention periods are established in accordance with regulatory obligations and business requirements, such as:

  • Payroll and government compliance: 10 years (BIR RR No. 17-2013)
  • Other HR data: Minimum of 5 years after separation or as required by law

Data deletion shall follow secure protocols (e.g., cryptographic wipe or secure erase) per National Privacy Commission (NPC) guidelines and applicable laws. When deletion is not technically feasible, anonymization shall be applied to remove personal identifiers in accordance with NPC Circular 2022-01.

All HRIS data shall be regularly backed up using encrypted systems with off-site or cloud redundancy. Backup data shall follow the same retention and deletion schedules.

6. Use of Location and Camera

Certain system features require access to your device for the following:

  • Location (GPS/IP): For time in/out validation
  • Camera: For self-portrait capture to prevent proxy attendance

These permissions will be explicitly requested. Disabling them may limit certain functionalities but does not prevent access to your core HRIS records.

7. Cookies and Web Analytics

When accessing HRIS via a web browser, cookies may be used to:

  • Maintain secure login sessions
  • Track user activity for performance optimization
  • Enhance overall user experience

You may disable cookies through your browser settings, though some features may be affected.

8. International Data Transfer

While the HRIS infrastructure is primarily hosted in the Philippines, technical support or data backups may involve limited access by authorized affiliates located abroad. FOPM ensures compliance with Philippine privacy laws and safeguards all data through encrypted channels and restricted access protocols.
